Different Kinds of Alimony

There are different types of spousal support. These include:
  • Temporary spousal support may be awarded during the divorce process. It is intended to provide immediate financial assistance to the dependent spouse until a final settlement or court-ordered resolution is reached.
  • Transitional spousal support is designed to prepare for reentry into the job market, or to advance therein with the goal of gaining financial independence. A party must have a plan for further education or training in order to qualify for transitional spousal support.
  • Compensatory spousal support may be awarded when there has been a significant financial or other contribution to the education, training, vocational skills, career or earning capacity of the other spouse during the marriage. It is intended to “compensate” a spouse for contributions that he or she made to the other spouse’s career outside the ordinary contributions that exist with many married couples.
  • Maintenance spousal support is what most people think of when the topic of spousal support or alimony comes up. It is an award of financial support from one party to another for a specified or indefinite period, depending in part upon the financial needs and resources of each spouse. The goal of maintenance support is to enable the parties to live separately at a standard of living comparable to that enjoyed during the marriage, to the extent possible.
Determining the appropriate type and amount of spousal support can be complex. Various factors — such as income, earning potential, length of marriage, and contributions made during the relationship — are all taken into consideration. Our experienced spousal support attorneys will guide you through this process and fight for your financial well-being.
